General Terms and Conditions (GTC)
1. Scope of Application These General Terms and Conditions apply to all reservations and accommodation contracts concluded between Ingrid Franz (hereinafter referred to as “The Calm Palm”) and the guest. By making a booking, the guest acknowledges these terms and conditions as binding.
2. Conclusion of Contract The accommodation contract is concluded upon the acceptance of the guest’s written or oral request by The Calm Palm. Reservation confirmation is usually sent via email. For short-term bookings, the provision of the service may replace the written confirmation.
3. Services and Prices The Calm Palm is obliged to provide the rooms booked by the guest and to perform the agreed services. The guest is obliged to pay the applicable prices for the room provision and any other services used. All prices are in the currency indicated in each case.
4. Payment Terms Payment modalities are agreed upon individually as part of the reservation confirmation. Unless otherwise agreed, the total amount is to be paid on-site or via advance bank transfer. Any fees for international bank transfers or currency conversions shall be borne by the guest.
5. Withdrawal by the Guest (Cancellation) A withdrawal by the guest from the contract concluded with The Calm Palm must be made in writing. The following cancellation conditions apply:

Up to 30 days before arrival: Cancellation is free of charge.

29 to 14 days before arrival: 50 percent of the agreed price.

From 13 days before arrival or in case of non-arrival (No-Show): 90 percent of the agreed price. We recommend taking out travel cancellation insurance to cover potential costs in case of illness.
6. Withdrawal by The Calm Palm The Calm Palm is entitled to withdraw from the contract for objectively justified reasons, particularly if force majeure or other circumstances beyond the provider’s control make the fulfillment of the contract impossible. In this case, the guest will be informed immediately, and any payments already made will be refunded.
7. Arrival and Departure Unless otherwise agreed, the booked room is available from 2:00 PM on the day of arrival. On the day of departure, the room must be vacated by 11:00 AM at the latest.
8. Liability The Calm Palm is liable with the diligence of a prudent businessman. Liability for items brought in is governed by statutory provisions, provided these fall within the provider’s area of responsibility. No liability is assumed for service disruptions in connection with services that were merely brokered as third-party services (e.g., external round trips or external transfer services).
9. Data Protection The processing of personal data is carried out in accordance with the applicable Privacy Policy, which can be viewed on the website at any time.
10. Final Provisions Amendments or supplements to the contract must be made in writing. Austrian law shall apply. The place of jurisdiction is, as far as legally permissible, Vienna. Should individual provisions of these GTC be invalid, this shall not affect the validity of the remaining provisions.
